Since the invention of the automobile, different agencies at all levels of American government have attempted to control the speed of traffic on the roads they are responsible for. This normally takes the form of fines, with different jurisdictions issuing them by way of traffic police (either overt, hidden, or unmarked) or traffic cameras. Sometimes speed bumps or narrower lanes are tried to get cars to slow down. Montana, however, famously once took a different approach. What if instead of a hard numerical limit, drivers were simply asked to keep to a speed that was reasonable and prudent? There would still be limits at night, and for large trucks, and were a driver to behave recklessly, a police officer could still issue a citation. Otherwise, though, drivers were left to decide for themselves what an appropriate speed for the conditions were. This situation held for a number of years in the late 1990s, until a driver cited for driving at an unreasonable, imprudent speed was able to convince a court that they were not liable for the ticket because the law was too vague. The court ruled the speed limit unconstitutional, and Montana was forced to adopt a numerical speed limit like everywhere else.
